Montana State Regulations

In Montana, all employers with one or more employees are required to carry workers’ compensation insurance. This coverage can be obtained through the Montana State Fund, a private insurer, or by qualifying for self-insurance if the employer meets specific criteria. Sole proprietors and partners are automatically excluded from coverage but have the option to opt-in. Corporate officers and LLC members with a substantial ownership interest are also excluded but can elect to be covered.
