Delaware State Regulations
In Delaware, all employers with one or more employees are required to carry workers’ compensation insurance. This coverage can be obtained through a private insurer or by qualifying for self-insurance if the employer meets specific criteria. Sole proprietors and partners are generally excluded from mandatory coverage but have the option to opt-in. Corporate officers and LLC members are also excluded unless they elect to be covered. Delaware’s system ensures that injured workers receive necessary medical care, wage replacement, and rehabilitation services. The Delaware Office of Workers’ Compensation oversees compliance, enforcing regulations and imposing penalties on employers who fail to provide the required coverage, thereby safeguarding workers’ rights and benefits.
